The Drunkenness Defense [John J. Pitney Jr.]

Mark Foley has checked into rehab.  The drunkenness defense has a long history, but is not effective. In its October 20, 1980 edition, Newsweek wrote of Representative John Jenrette (D-SC), whom the FBI had caught in a famous sting operation: “Jenrette, convicted last week of accepting a $50,000 bribe in the Abscam investigation, continued to insist that the bribe was part of a legitimate business deal and that he had been hopelessly confused by alcohol during his meeting with the undercover agents. FBI videotapes showed him boasting `I've got larceny in my blood—I'll take it in a goddamn minute.’ But Jenrette testified he had really said he had `alcohol in my blood. I'll do anything to get out of here.’ Unimpressed by his paraphrase, the jury returned a guilty verdict in less than five hours.”
